User Access and Choice

Tracking Technologies / Cookies
We use both session ID cookies and/or persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.

Web Beacons / Gifs
We employ a software technology called clear gifs (a.k.a. Web Beacons), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customers’ personally identifiable information.
Analytics / Log Files
As is true of most web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

You agree to indemnify and hold harmless AddressReport and its affiliates, and their respective members, directors, officers, managers, employees, shareholders, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from or relating to any use or misuse by you of our Services, including without limitation our email publications, email alerts, property reports, data, information, and/or website, or any violation by you of this policy and terms of service or any breach by you of your representations and warranties hereunder. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this section. In such event, you shall provide us with such cooperation as is reasonably requested by us.
Governing Law and Jurisdiction
This policy shall be governed by the laws of the United States and the State of New York applicable to agreements made and to be performed therein without regard to conflict of laws principles. You expressly agree that exclusive jurisdiction for any claim or dispute with AddressReport or relating in any way to your use of the Services resides in the courts of the United States located in the Southern District of New York or any state court located in New York County, New York AND WAIVE ANY RIGHT TO RESORT TO ANY FORM OF CLASS ACTION. These terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by AddressReport without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.
Entire Agreement / Severability
This policy and any amendments and any additional agreements you may enter into with AddressReport in connection with the Services, shall constitute the entire agreement between you and AddressReport concerning the Services. If any provision of these terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these terms will remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and AddressReport’s failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.
